If You Paid Overdraft Fees to Capital One, Hibernia, or North Fork, You May Be Eligible for a Payment from a Class Action Settlement1.

Update: On July 18, the Court approved a Phase II Distribution to all eligible Settlement Class members to exhaust the remaining funds. In August, 2017 Phase II Settlement checks were issued to Settlement Class Members who previously participated in the initial distribution of Settlement funds and for whom the pro rata share of the second disbursement is equal to or greater than $5.00.

Case Background

In May 2015, a $31,767,200 Settlement was approved in a class action about the order in which Capital One, N.A. (“Capital One”) posted Debit Card Transactions to customer Accounts, and the alleged effect the posting order had on the number of Overdraft Fees charged to Account holders. Capital One maintains that there was nothing wrong about the posting process used and that it has not violated any laws. The Court has not decided which side is right.

Current and former holders of Capital One consumer checking accounts (including former customers of Hibernia Bank and North Fork Bank) may be eligible for a payment or Account credit from the Settlement Fund.
